Terms of Service
Welcome to HeyVini ("HeyVini", "we", "us", "our"). These Terms of Service ("Terms") govern your use of the HeyVini website, web application, and the Vini companion service delivered through WhatsApp, Telegram, and the web (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What HeyVini is — and what it is not
HeyVini provides daily check-ins, task and medicine reminders, family alerts, and family contact storage for households caring for aging family members.
- HeyVini is not a medical service. Vini does not provide medical, legal, or financial advice, diagnosis, or treatment. Reminders are an aid, not a substitute for professional care or a caregiver's judgment.
- HeyVini is not an emergency service. Alerts to family members depend on third-party messaging networks and internet connectivity and may be delayed or fail. In an emergency, always contact local emergency services directly.
- HeyVini does not track location, record audio, or monitor anyone passively. It only sends messages and reads replies.
2. Eligibility and accounts
The family admin who creates an account must be at least 18 years old. You are responsible for the accuracy of the information you provide and for activity that occurs under your account. Keep your login email secure; we use one-time codes instead of passwords.
3. Adding family members
When you add a family member and share their join link, you confirm that you have their permission (or are legally entitled) to add them and to share their name, phone number, time zone, and related details with us. Family members can ask us to remove their information at any time (see our Privacy Policy).
4. Acceptable use
You agree not to misuse the Service, including by: using it to harass or monitor a person without their knowledge and consent; attempting to access another family's data; interfering with or disrupting the Service; reverse engineering the Service; or using the Service in violation of applicable law or the terms of WhatsApp or Telegram.
5. Plans, billing, and trials
The Free plan is provided at no charge with the features described on our website. The Family plan is billed at USD $7 per month (or as otherwise displayed at purchase) and includes a free introductory period as shown at signup. Prices may change with reasonable notice; changes apply from your next billing cycle. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
6. Messaging channels
The Service delivers messages through third-party platforms (WhatsApp via Twilio, and Telegram). Message delivery depends on those platforms and on your and your family members' devices and connectivity. We are not responsible for failures, delays, or changes imposed by those platforms.
7. Your content
You retain ownership of the information you and your family members submit (messages, tasks, contacts, check-in replies). You grant us a limited licence to process this information solely to operate, secure, and improve the Service, as described in our Privacy Policy.
8. AI-generated responses
Vini's replies are generated with the help of artificial intelligence and may occasionally be inaccurate or incomplete. Do not rely on Vini's replies for medical, legal, financial, or emergency decisions. If a reply seems wrong, please tell us.
9. Availability
We aim to keep the Service available and reliable, but it is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We may modify, suspend, or discontinue features with reasonable notice where practicable.
10. Limitation of liability
To the maximum extent permitted by law, HeyVini and its operator shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service — including missed or delayed reminders, check-ins, or alerts. Our total aggregate liability for all claims relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim (or USD $10 if you use only the Free plan). Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if we discontinue the Service, with reasonable notice where practicable. Upon termination, we delete or anonymise your family's data as described in our Privacy Policy.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts of competent jurisdiction in India shall have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protections that apply in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you through the Service or by email before it takes effect. Continued use after the effective date constitutes acceptance.
